User agreement. Terms of use of the website nfarchstudio.com

(hereinafter – the “Agreement”)

1. The website nfarchstudio.com/ (hereinafter – the “Website”) is owned by Sole Proprietor Nadezhda V. Fedotova (Primary State Registration Number of the Individual Entrepreneur [OGRN IP] 320100100013842, Taxpayer Identification Number [INN] 100123054760 – hereinafter the “Website Administration”), and is available on the Internet at: https://nfarchstudio.com.

2. The Website is intended for:

   1. publishing information on the development of architectural concepts for schools and kindergartens (automatic generation of technical specifications and projects for schools and kindergartens for specific tasks);

   2. conducting research related to schools and kindergartens and publishing the results of such research on the Website;

   3. conducting surveys and interviews with respondents related to schools and kindergartens and publishing the results of such surveys and interviews on the Website.

The Website provides access to its materials for the purpose of obtaining and using information and architectural projects, their descriptions, and expert opinions.

3. The Website is intended for persons over 18 years of age. If any materials on the Website are intended for persons under 18 years of age, the decision on granting access to such materials to a person under 18 shall be made by the legal representative of such minor.

4. This Agreement applies to the following Website Users: any individuals (including sole proprietors) and legal entities (hereinafter – “Users”) and is binding upon them.

5. By using the Website, the User is deemed to have entered into this Agreement, agrees with its terms, and undertakes to comply with them.

6. This Agreement is a legally binding agreement between the User, on the one hand, and the Website Administration, on the other hand. The subject of the Agreement is the provision by the Website Administration of services to the User for the use of the Website and its services (hereinafter – the “Services”). The Agreement also governs relations with third parties if their rights and interests may be affected by the actions of Website Users.  

7. The User must carefully read the terms of this Agreement before starting to use the Website. Use of the Website by the User constitutes full and unconditional acceptance of the terms of the Agreement and consent thereto.

8. All rights to the Website as a whole and to the use of the network address (domain name) nfarchstudio.com belong to the Website Administration, which provides access to the Website to all interested parties (Users) in accordance with this Agreement and the legislation of the Russian Federation.

Confidentiality and Use of Users’ Personal Data

1. The Website Administration ensures the confidentiality of personal data obtained through the Website and fulfills other requirements provided by the legislation of the Russian Federation regarding the storage and processing of personal data and information confidentiality. The Policy on Personal Data Processing is published on the Website.

2. By using the Website, the User consents to the processing and use of personal data under the conditions set forth in the Policy on Personal Data Processing and under the terms of specific Consents.

3. The Website also collects and processes anonymized data about Website Users using web analytics services. Anonymized data that is automatically transmitted to the Website Administration during its use via software installed on the User’s device includes IP address, cookie data, information about the User’s browser (or other software used to access the Website), technical specifications of the equipment and software used by the User, date and time of access to the Website, addresses of requested pages, and other similar information.

Use of Website Materials

1. Any materials published on the Website are objects of intellectual property (copyright or related rights, as well as rights to means of individualization) and belong to the Website Administration and/or the respective right holders.

3. If it is necessary to grant rights to the Website materials on terms other than those specified in this Agreement, the User has the right to submit the corresponding request to the Website Administration.

Miscellaneous Provisions

1. The Website Administration reserves the right to amend this Agreement unilaterally at any time without notifying Users. Any amendments will be published on the Website. The amendments shall take effect from the moment they are published on the Website. The Website Administration recommends that Users regularly review the terms of the Agreement for changes and/or additions. Continued use of the Website by the User after amendments and/or additions to the Agreement have been made constitutes the User’s acceptance and consent to such amendments and/or additions.

2. The User is obliged to use the Website in good faith, without violating the legislation of the Russian Federation, the rights and freedoms of third parties, as well as the principles of ethics, morality, and decency. The User agrees not to use the Website and its services for the following purposes:

   • uploading content that is illegal, violates the rights of third parties; promotes violence, cruelty, hatred and/or discrimination on racial, national, gender, religious, social, or any other grounds; contains false information and/or insults directed at specific individuals, organizations, or government authorities;

   • inciting unlawful acts, participation in mass (public) events conducted in violation of the established procedure, or assisting persons whose actions are aimed at violating restrictions and prohibitions in force in the territory of the Russian Federation;

   • violating the rights of minors and/or causing them harm in any form;

   • infringing on the rights of minorities;

   • impersonating another person or a representative of an organization and/or community without sufficient authority, including impersonating representatives of the Website Administration;

   • misleading others regarding Website materials; engaging in improper comparisons or fostering negative attitudes toward individuals who do (or do not) use Website materials, or condemning such individuals;

   • uploading content that the User does not have the legal right to make available under applicable law or due to contractual or other restrictions;

   • uploading content that involves and/or contains any patent, trademark, trade secret, trade name, intellectual property objects, including results of intellectual activity, belonging to or lawfully used by third parties;

   • uploading unauthorized advertising information and/or spam;

   • collecting and processing personal data or private information of any persons;

   • disrupting the normal operation of the Website;

   • violating Russian or international law.

3. The Website may contain links to other websites on the Internet (third-party websites). Such third parties and their content are not reviewed by the Website Administration for compliance with any requirements (accuracy, completeness, legality, etc.). The Website Administration is not responsible for any information, materials, placed on third-party websites to which the User gains access using the Website, including any opinions or statements expressed on third-party websites, advertising, etc., as well as for the availability of such websites or their content and the consequences of their use by the User.

4. The Website may contain links to surveys and research conducted by the Website Administration. By participating in such surveys and research, the User agrees that:

   1. information, data, responses to questions provided by the User during the survey/research may be used by the Website Administration in anonymized form;

   2. the Website Administration has the right to disclose, publish, and make publicly available the responses, information, and data provided by the User without obtaining prior additional consent and without indicating the name/pseudonym of the author;

   3. if the information, data, responses to questions provided by the User during the survey/research contain results of intellectual activity, the User grants the Website Administration a non-exclusive, royalty-free license to use such results of intellectual activity in any manner, including those specified in Article 1270 of the Civil Code of the Russian Federation, without territorial limitations, for the entire term of protection of the corresponding intellectual property rights.

5. The Website Administration does not guarantee that the Website will meet the User’s requirements, or that access to the Website will be provided continuously, promptly, reliably, and without errors. The Parties agree that software and hardware errors, whether on the part of the Website Administration or the User, resulting in the User’s inability to access the Website, are considered force majeure circumstances and grounds for exemption from liability.

7. In all matters not regulated by this Agreement or by special terms of other documents, the Parties shall be governed by the provisions of the legislation of the Russian Federation.
